Introduction for Buyers

Buyers using TechSwap are consumers under consumer protection law and contracting parties in electronic transactions with sellers through the platform. By using the platform, you acknowledge that you have read, understood, and accepted this policy together with the Terms of Service and Privacy Policy.

Rule 1.1

Registration, Identity Verification, and Account Security

Buyers must register with accurate, complete, and current information under the Electronic Transactions Act B.E. 2541 (1998), which requires identifiable parties in electronic transactions, and the Personal Data Protection Act B.E. 2562 (2019) (PDPA), which governs lawful and transparent personal data processing.

  • Provide truthful personal information. Do not impersonate others or use another person's data unlawfully.
  • Complete electronic identity verification (eKYC) as required before transactions that need verification.
  • Keep your username, password, OTP, and access credentials confidential. Do not allow unauthorized account use.
  • Notify TechSwap immediately if you suspect unauthorized access or a data security incident.
  • Actions under your account are presumed to be yours unless you prove unauthorized use and prompt notification.
  • Your personal data is processed per our Privacy Policy and PDPA. You may exercise access, correction, objection, restriction, and withdrawal rights as provided by law.

Rule 1.2

Searching, Evaluating, and Purchase Decisions

Under the Consumer Protection Act B.E. 2522 (1979), buyers have the right to accurate information before purchase. If you select Premium inspection through TechSwap Inspection Hub, the platform verifies product condition and listing accuracy per defined steps, giving you additional protection. If you do not select inspection, you must evaluate and inspect on your own and accept the related risks.

  • Review full product details, brand, model, condition, age, accessories, and limitations before ordering.
  • Verify seller photos and videos. Ask questions in-platform and keep communication records if information is unclear.
  • Consider Trust Score, verification status, and seller history.
  • If Premium inspection via TechSwap Inspection Hub is selected, follow platform steps without needing the same depth of self-inspection as when inspection is not selected.
  • If inspection is not selected, you must inspect and evaluate goods yourself and accept risks from the lack of platform inspection.
  • Be cautious of abnormal offers, such as unusually low prices or pressure to pay off-platform.
  • If you suspect a seller or user is a scammer, you may report to TechSwap or relevant authorities with evidence.

Rule 1.3

Orders, Payment, and Electronic Contracts

When you confirm an order and pay through TechSwap, you make an electronic offer or contract under the Electronic Transactions Act, based on the product, price, shipping, and optional service fees shown at checkout.

  • Review items, price, shipping, Premium inspection fees (if selected), and total before confirming.
  • Pay only through platform channels. Do not transfer directly to sellers off-platform.
  • Keep payment proof, order numbers, and transaction status until the transaction is complete.
  • Cancellation before seller confirmation may follow system rules. After confirmation, cancellation requires valid grounds under applicable policies.
  • Do not create fake orders, repeatedly cancel without cause, or disrupt the system, which may violate computer crime laws.
  • If payment succeeds but status is not updated, contact support with proof within a reasonable time.

Rule 1.4

Shipping, Receipt, and Transit Risk

Buyers must provide a correct delivery address and receive goods within a reasonable time. Loss or damage in transit is assessed per agreement, shipping evidence, and platform policy, with consumer protection principles where goods are not delivered as agreed.

  • Verify delivery address, recipient name, and contact number before confirming.
  • Track orders in your profile Orders page and cooperate with carriers.
  • Inspect outer packaging before opening. Photograph or video severe damage immediately.
  • Report non-delivery within the system deadline for investigation.
  • Do not unreasonably refuse delivery after proper shipment by the seller.
  • Failing to inspect and report issues within the allowed window may affect later claims.

Rule 1.5

Inspection, Buyer Confirmation, and Legal Effect

TechSwap operates an Inspection Hub for orders with Premium inspection selected, verifying product condition and listing accuracy before buyer confirmation. If selected, you may rely on the platform inspection process as disclosed. If not selected, you must inspect goods yourself upon receipt and accept risks from the lack of platform inspection.

  • With Premium Inspection: wait for TechSwap Inspection Hub results before confirming receipt, per system steps.
  • Without inspection: inspect exterior, screen, battery, core functions, IMEI/Serial, and accessories yourself.
  • Without inspection: perform reasonable functional tests appropriate to the product type.
  • Confirm receipt only when satisfied, within the system deadline.
  • If goods do not match the listing, have undisclosed defects, or malfunction, file a dispute with evidence. Do not confirm.
  • If the confirmation window expires without a report, the system may auto-confirm per disclosed rules.

Rule 1.6

Complaints, Disputes, Refunds, and Mediation

If goods are misdescribed, defective, or the seller breaches the contract, buyers may file a dispute within 7 days of the delivered status and before confirming receipt. TechSwap will review evidence and mediate or decide per policy and applicable law, including consumer protection principles.

  • Report issues in-platform with evidence such as photos, videos, and in-system messages.
  • Describe problems honestly, completely, and factually.
  • Do not alter, edit, or falsify evidence, which may constitute criminal offenses.
  • Cooperate with review, including returns if required within stated timelines.
  • When a refund is approved, TechSwap submits the request to INET within 1 business day. Final credit time depends on INET and the receiving bank.
  • TechSwap does not charge an additional refund fee. Original shipping or service charges are assessed based on the cause and review outcome.
  • Refunds or remedies follow review outcomes, Terms of Service, and platform criteria.
  • If dissatisfied with platform resolution, you may pursue rights under consumer law or relevant authorities.

Rule 1.7

Consumer Rights Under Law

As consumers under the Consumer Protection Act B.E. 2522 (1979) and related law, buyers are entitled to accurate information, reasonable safety, and goods as agreed, without limiting mandatory consumer rights.

  • Right to accurate information on products, price, terms, and sellers before purchase.
  • Right to goods matching descriptions and reasonable quality for used items.
  • Right to seek repair, replacement, price reduction, or cancellation where law and facts allow.
  • Right to complain to TechSwap or relevant consumer protection authorities.
  • Right to compensation for harm from unsafe or misdescribed goods where law provides.
  • Seller disclaimers must not conflict with mandatory consumer protection provisions.

Rule 1.8

Buyer Personal Data (PDPA)

TechSwap processes buyer personal data under the PDPA for service delivery, identity verification, order processing, fraud prevention, and legal compliance.

  • Data may include name, address, phone, email, payment-related data, shipping addresses, and usage data.
  • Processing is limited to necessity and lawful bases under the PDPA.
  • You may exercise access, correction, deletion, objection, restriction, portability, and consent withdrawal as provided by law.
  • Do not use seller or other user data in ways that violate the PDPA, such as spam or unjustified disclosure. Reporting suspected scammers or issues to TechSwap and relevant authorities with evidence is permitted.
  • See TechSwap Privacy Policy for full details.

Rule 1.9

Prohibited Conduct and Legal Violations (Buyers)

Buyers must not engage in unlawful acts, violate others' rights, or harm the platform. Violations may lead to suspension and criminal or computer crime liability.

  • Do not deceive, pressure, harass, or use abusive language toward sellers or staff.
  • Do not file false disputes or use fake evidence.
  • Do not repeatedly cancel orders without valid cause to harm sellers.
  • Do not attempt off-platform transactions to evade fees or protections.
  • Do not unlawfully access systems, data, or other users' accounts.
  • Do not commit fraud, money laundering, or other offenses under the Criminal Code.

General Provisions and Applicable Law

The following applies to all buyers, sellers, and users on TechSwap.

  • TechSwap may temporarily restrict access during urgent investigations.

Rule 3.3

  • Serious single violations may result in immediate permanent suspension.
  • Repeated violations may lead to temporary or permanent suspension.
  • Related accounts may be suspended if coordinated abuse is found.
  • Users may appeal or inquire through Help Center per defined steps.
  • Suspension does not affect legal claims against counterparties or authorities.

Rule 3.4

Personal Data Protection (PDPA)

TechSwap processes personal data under the PDPA and Privacy Policy. Sellers who complete eKYC provide necessary information such as legal name, national ID number, birth date, ID-card images, and laser code so the ID data can be checked with the Department of Provincial Administration (DOPA). All users must not unlawfully use others' personal data.

  • Data is collected only as necessary with lawful bases.
  • eKYC data is used for identity verification, seller access, impersonation prevention, and necessary complaint or dispute review.
  • Data is retained only as long as needed for transactions, safety, investigations, and legal duties, then deleted, destroyed, or de-identified under the retention policy.
  • Appropriate security measures are applied.
  • Data subjects have PDPA rights including consent withdrawal in some cases.
  • Users must not unlawfully collect, use, or disclose others' personal data.
  • See TechSwap Privacy Policy for details.

Rule 3.5

Governing Law, Disputes, and Policy Amendments

  • Thai law governs interpretation and application of this policy.
  • Platform disputes should first be mediated; otherwise per Terms of Service and law.
  • If any provision is unenforceable, other provisions remain effective.
  • Continued use after updates constitutes acceptance of the new policy.
  • Check this page periodically for changes.

Rule 3.6

This policy works with Terms of Service, Privacy Policy, and Cookie Policy. If conflicts arise, the more specific document governs that subject without limiting mandatory consumer rights.

  • Read Terms of Service and Privacy Policy together with this policy.
  • Material changes may be notified via platform or email where appropriate.
  • If you do not accept changes, you may stop using the service and close your account.
  • Mandatory consumer rights remain effective despite policy changes.
